The Department of Planning & Development has researched the pin numbers for these two properties and have clarified that the parcels are nonconforming under the McHenry County Unified Department Ordinance and therefore buildable for a residence. In order to make this determination, the county examined the size, and width of the parcels and and the minimum buildable requirements in effect at the time of their creation. These two parcels 03-30-100-010, frontage of 225 ft., & 03-30-100-011, frontage of 178, were recorded on May 15, 1978. The minimum requirements for buildability at that time for an agriculturally zoned parcels were 5 acres with 160 feet of average width. Because these requirements are met, the parcel is nonconforming, therefore the department would issue a permit to build a residence. The public Health Ordinance, which regulates wells and septic systems and the Stormwater Management Ordinance which regulates development in floodplains and wetlands.
